ENROLMENT TERMS AND CONDITIONS

I am the parent, guardian and/or the person with authority and/or responsibility over the enroled child or children. By enrolling the named child or children, I understand, agree with and consent to the following terms and conditions made with Caroline Springs Tutoring, herein referred to as “Caroline Springs Tutoring”:

GENERAL
1) That these terms and conditions, and these terms and conditions alone, will govern both my relationship, and the relationship of the enroled child or children with Caroline Springs Tutoring.
2) That these terms and conditions may be subject to change and/or be varied at any point in time. Should this be the case, Caroline Springs Tutoring will notify me of any substantial/significant changes and/or variations in writing as soon as possible.

TUITION FEES AND PAYMENT OF TUITION FEES
3) That I will pay the quoted tuition fees in advance / on the day of the enroled child or children’s pre-booked tuition sessions.
4) That Caroline Springs Tutoring has the right to refuse to offer tuition to the enroled child or children should I fail to pay the quoted tuition fees in advance / on the day.

NON-ATTENDANCE
5) That all tuition deposits fees are subject to the following terms in the event that the enroled child or children fail to attend their pre-paid and scheduled class:
a) All pre-paid and scheduled Group Tuition sessions are refundable if the session has not taken place by the student and 48 hour notice of cancellation, otherwise they can re-schedule to a suitable make up tutor class
b) I understand that it is my responsibility to ensure that the enroled child or children attends his/her/their pre-paid and scheduled class.
c) There will be a 50% cancellation fee if not advised 48 hours in advance for the lesson cancellation or two lessons cancellation in a month. This will be taken out of your deposit and/or added to next student payment lesson unless medical certificate is provided

REFUND POLICY
6) That all pre-paid tuition fees are subject to Caroline Springs Tutoring Refund Policy, that is:
a) All attended pre-paid sessions are non-refundable where the enroled child or children:
i) Leave prior to the conclusion of the pre-paid session due to sickness and/or any other reason without 48 hour notice unless medical certificate is provided and/or;
ii) Fail to co-operate and learn, and/or engage in unlawful, inappropriate and/or disrespectful behaviour during the pre-paid session.
b) All attended pre-paid sessions are non-refundable where the enroled child or children are unable to receive tuition services for circumstances outside of Caroline Springs Tutoring ‘s control, eg. in cases of natural disasters and/or emergencies, enforced evacuations etc.
c) All pre-paid sessions that are cancelled by Caroline Springs Tutoring will be fully refundable and no cancellation fees and/or deposit/booking fees will be payable. Caroline Springs Tutoring will seek to ensure that all pre-paid sessions and scheduled sessions are run, but this may not always be possible due to circumstances outside of Caroline Springs Tutoring’s control.
7) That Caroline Springs Tutoring will seek to ensure that the same tutor will be offering the enroled child or children their tuition during their pre-paid and scheduled class, but I understand that this may not always be possible due to sickness and external circumstances outside of Caroline Springs Tutoring’s control.
8) That pre-paid tuition fees are made on a per-child basis and that no pre-paid tuition fees will be transferable to another child.
9) That family discounts are applicable only to siblings from the same household.
10) That the tuition fees may be subject to change and/or be varied at any point in time. Should this be the case, Caroline Springs Tutoring will notify me of any changes and/or variations in writing as soon as possible.

TUITION AND RESPONSIBILITY FOR LEARNING
11) That Caroline Springs Tutoring ’s services are dynamic and variable, and that the nature of the tuition offered to the enroled child or children will be dependent on a number of factors, including but not limited to: my requests and recommendations; the enroled child or children’s expressed requests, wants and needs; and the tutor’s observed needs of the enroled child or children.
12) That Caroline Springs Tutoring will endeavour to assist the enroled child or children to progress and improve academically, but cannot and does not guarantee improved academic results and/or academic achievements and/or entry into any selective school/program through its tuition services. I understand that there are a significant number of factors which impact on the progress and improvement of the enroled child and children’s academic results and/or academic achievements and/or entry into any selective school/program.
13) That Caroline Springs Tutoring will where appropriate, provide the enroled child or children with homework to reinforce his/her/their learning. Although the tutors at Caroline Springs Tutoring will encourage the enroled child or children to complete their homework, it is outside of Caroline Springs Tutoring ’s responsibility to ensure that this happens.
14) That Caroline Springs Tutoring tutors will correct homework that has been submitted to them by the enroled child or children within a reasonable timeframe. Caroline Springs Tutoring’s tutors are not expected to nor required to correct any homework that has been submitted to them more than two weeks from the date it was initially provided to the enroled child or children.

EXPECTED CONDUCT AND BEHAVIOUR AND DAMAGE TO PROPERTY
15) That Caroline Springs Tutoring will require that the enroled child or children behave lawfully, appropriately and respectfully during their tuition session towards their tutor and other children within their session and campus. Should the enroled child or children fail to behave lawfully, appropriately and respectfully during their tuition session towards their tutor and/or other children within their session and campus, they will be removed from their tuition session and asked to sit at reception until they are picked up and/or the conclusion of their tuition session.
16) That Caroline Springs Tutoring may unenrol the enroled child or children from any further tuition session should the enroled child or children fail to modify and/or rectify their behaviour by their subsequent tuition sessions.
17) That Caroline Springs Tutoring will require that the enroled child or children take appropriate care of and refrain from damaging Caroline Springs Tutoring’s premises, resources and furniture. Should the enroled child or children recklessly, intentionally and/or maliciously damage Caroline Springs Tutoring’s premises, resources and/or furniture, I understand that I will be held responsible for the costs of repairing and/or replacing the relevant parts of the premises, resources and/or furniture.
18) That Caroline Springs Tutoring will not be held responsible or liable for any damage to and/or loss of any property brought into Caroline Springs Tutoring’s premises by the enroled child or children. It is the preference of Caroline Springs Tutoring that children do not bring valuable property into their tuition sessions.
19) That the enroled child or children will not bring any dangerous goods or substances onto the Caroline Springs Tutoring premises.

HEALTH AND SAFETY AND INDEMNITY
20) That I am responsible for informing Caroline Springs Tutoring regarding any medical condition and/or illness that requires any specific medical or like treatment regarding the enroled child or children. Caroline Springs Tutoring will not be able to provide any medical or like treatment, but will inform me as soon as possible should the enroled child or children require medical or like treatment. In cases of emergencies, Caroline Springs Tutoring will contact “000” for assistance. I understand that I will be fully responsible and liable for all medical and like expenses incurred in the monitoring and/or treatment of the enroled child or children.
21) That I am responsible for ensuring the health and safety of the enroled child or children prior to and after his/her/their scheduled tuition sessions. I am responsible for ensuring that the enroled child or children are dropped-off and picked-up on time and by the appropriate person. Caroline Springs Tutoring will not be responsible for the health and safety of the enroled child or children before and after their scheduled tuition sessions, and/or responsible and liable for ensuring that the enroled child or children will be dropped-off and picked-up on time and by the appropriate person.
22) That Caroline Springs Tutoring will endeavour to ensure that the enroled child or children does not leave prior to their scheduled session concluding, and will only permit the enroled child or children from leaving prior to their scheduled session with my prior written and/or verbal consent, and/or the written and/or verbal consent from another parent and/or guardian of the enroled child or children.
23) That Caroline Springs Tutoring will endeavour to provide a healthy and safe environment for learning for the enroled child and children. However, Caroline Springs Tutoring is not responsible or liable for any natural disasters, accidents, injuries, deaths, losses, damages, expenses or liabilities that are sustained and/or incurred by the enroled child or children other than that imposed by law during our tuition sessions and/or on or around our premises.
24) That Caroline Springs Tutoring will be released from any indemnity for any claim or action brought against Caroline Springs Tutoring by the enroled child or children, on behalf of the enroled child or children, family members of the enroled child or children and/or any other party related to or connected with the enroled child or children arising out of the natural disasters, accidents, injuries, deaths, losses and/or damages other than that imposed by law.

INFORMATION
25) That all the information that I have provided within the enroled child or children’s Enrolment Form and to Caroline Springs Tutoring is true, correct and can be relied upon.
26) That I am required to inform Caroline Springs Tutoring should any of my contact details and other important details regarding the enroled child and children change.
27) That Caroline Springs Tutoring is free to use the information that I have provided for the purposes of:
a) enrolling the named child or children for tuition at Caroline Springs Tutoring;
b) informing me of any changes to the enroled child or children’s enrolment and/or sessions;
c) contacting me for the purposes of obtaining general consent, authority, advice and/or information;
d) contacting me in cases of emergencies and/or to seek medical instruction, advice and/or attention;
e) providing updates regarding the progress of the enroled child or children’s tuition;
f) providing updates regarding the operations of Caroline Springs Tutoring and;
g) any other purpose that is deemed necessary or relevant to the provision of Caroline Springs Tutoring’s services.
28) That Caroline Springs Tutoring is permitted to take a photo of the enroled child or children for the sole purpose of identification, which will be stored on our secure student database, and accessible to Caroline Springs Tutoring staff.
